These Terms of Service (“Terms”) govern your access to and use of Educaholic (the “Service”), an AI-powered learning product operated by Educaholic Ltd (CNPJ 42.646.519/0001-91) (“Educaholic”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Educaholic helps working professionals build personalized learning paths using AI-powered guides. The Service is provided for educational and informational purposes only. It does not provide professional, legal, financial, medical, or career advice, and it is not a substitute for professional judgment.

Accounts

You must provide accurate information when you create an account, and you are responsible for activity that occurs under your account. You must be at least 16 years old to use the Service. Authentication, including Google sign-in, is handled by our provider, Clerk. Keep your sign-in credentials secure and notify us promptly of any unauthorized use.

Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or abusive purpose, or to generate or distribute illegal or harmful content.
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its underlying systems.
• Scrape, resell, or systematically extract content from the Service except as expressly permitted.
• Infringe the intellectual property or privacy rights of others.

AI-generated content

The Service uses artificial intelligence to generate learning content, guides, and recommendations. AI output can be inaccurate, incomplete, or out of date. You are responsible for evaluating the suitability and accuracy of any content before relying on it. We make no guarantee that generated content is correct, complete, or fit for a particular purpose.

Your content

You retain ownership of the information and content you submit to the Service. You grant us a limited license to use, store, and process that content solely to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for the content you submit and for ensuring you have the right to submit it.

Intellectual property

The Service, including its software, design, branding, and original content, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial learning. These Terms do not transfer any of our intellectual property rights to you.

Plans, limits, and billing

The Service relies on third-party providers, including Google (sign-in), Clerk (authentication), and OpenAI (AI processing). Your use of those features may also be subject to those providers’ terms. We are not responsible for the practices of third-party services.

Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
